Terms of Use & Teacher Agreement

Effective May 31, 2026. The Service is operated by Money Instructor (“Money Instructor,” “we,” “us”).

By creating a teacher account or using Money Instructor Classroom (the “Service”), you agree to these terms. If you do not agree, do not use the Service.

1. What the Service is

The Service is Money Instructor Classroom, a classroom financial-literacy platform made up of interactive learning apps. The first is MI Bank, a classroom banking simulation using pretend money, and we may add other educational apps over time. The Service is not a bank, is not a financial institution, does not hold or move real funds, and must not be used to process real financial transactions.

Do not enter real bank account numbers, card numbers, Social Security numbers, dates of birth, home addresses, personal email addresses, or other sensitive personal or financial information into the Service.

2. Teacher accounts

Teacher accounts are for educators. You are responsible for keeping your password confidential and for activity under your account. Provide accurate account information and keep it current. The Service is not directed to students for self-registration; students do not create their own accounts and access the Service only through accounts a teacher creates for them.

3. Acting on behalf of a school

If you use the Service on behalf of a school, district, or other educational institution, you represent that you are authorized to accept these terms and to authorize use of the Service for your class. The U.S. Federal Trade Commission has noted that decisions about whether a service's data practices are appropriate are best made at the school or district level; we encourage you to confirm your school's approval before enrolling students.

4. Student information and children's privacy (COPPA)

When you create student records, you represent and agree that:

Authorized educational use. You create and manage student accounts for a legitimate educational purpose, and you provide only the limited student information the Service uses (a teacher-assigned username, an optional teacher-supplied student ID, and a PIN).
School consent for under-13 students. For students under 13, the school provides consent in place of individual parental consent for the collection and use of this limited student information for the school-authorized educational purpose, consistent with the school-consent approach recognized under the Children's Online Privacy Protection Act (COPPA) for educational tools.
No sensitive personal data. You will not enter students' real financial information or other sensitive personal data, and you will discourage students from doing so.
Parent requests. You will handle parent requests to review, export, or delete a child's records using the tools the Service provides, or by contacting us.

Where COPPA applies, Money Instructor relies on school authorization only for the collection and use of student information for the school-authorized educational purpose. Money Instructor remains responsible for its own obligations as the operator of the Service, including providing notice of its data practices and limiting use of student information to that educational context. Our practices are described in our Privacy notice.

5. FERPA and student records

To the extent student information in the Service constitutes “education records” under the Family Educational Rights and Privacy Act (FERPA), Money Instructor acts as a service provider (“school official”) under the direction and control of the school. We use student information only to provide and support the Service for the school, do not use it for our own commercial purposes, and do not disclose it except to our service providers acting on our behalf, as directed by the school, or as required by law. The school retains control of student-record data, including the right to access, correct, export, and delete it.

6. Acceptable use

Use the Service only for lawful, educational purposes. Do not attempt to disrupt or gain unauthorized access to the Service, other accounts, or other classes' data; do not upload unlawful or harmful content; and do not use the Service to collect personal information beyond what it is designed to hold.

7. Privacy

Our handling of teacher and student information is described in our Privacy notice, which forms part of these terms. We do not sell student data or use it for advertising or non-educational purposes.

8. Your content

You and your students retain ownership of the content you enter (such as class names and student usernames). You grant Money Instructor a limited license to host, process, and display that content solely to operate and support the Service for you. You are responsible for having the necessary rights and authority to enter it.

9. Your data, deletion, and retention

You can export your class records and remove classes and students from active use at any time. Deleted records may persist for a limited period in routine backups and security logs before they are deleted on our normal schedule, and we may retain information where required for legal, security, abuse-prevention, or school-directed record-retention reasons. Inactive archived data becomes eligible for automatic deletion as described in the Privacy notice.

10. Service and availability

The Service is currently offered free of charge. We do not promise any particular uptime, availability, or feature set, and we may add, change, or remove features at any time. We recommend exporting any records you need to keep.

11. Suspension and termination

We may suspend or end access for misuse, or to protect the security or integrity of the Service, other users, or student data. You may stop using the Service and delete your data at any time.

12. Disclaimers and limitation of liability

The Service is provided “as is” and “as available,” without warranties of any kind, to the fullest extent permitted by law. Because the Service's features are educational simulations, the Service is not responsible for any real-world financial decisions or losses.

To the fullest extent permitted by law, Money Instructor will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits. Money Instructor's total liability arising out of or relating to the Service will not exceed the greater of the amounts you paid us for the Service in the 12 months before the claim or US $100.

13. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The state and federal courts located in California will have exclusive jurisdiction over any dispute, except where applicable law requires otherwise.

14. School data agreements

If your school or district requires a separate data processing agreement or student-data-privacy agreement, contact us at help@moneyinstructor.com. Where a signed agreement is in place, its student-data terms control over any conflicting terms here.

15. Changes

We may update these terms; material changes will be reflected by a new effective date above.
